How I Used a Deviation Letter to Secure Leniency and Avoid Jail Time

Dear Accused,

Navigating the criminal justice system can often feel like an overwhelming and daunting journey, especially when a loved one is at the center of the storm. In a recent case in Arizona, I found myself in the role of advocate for my father, who was facing serious legal charges despite his declining health. Our story is one of persistence, careful communication, and, crucially, the recognition of the reasonableness and compassion displayed by the Pinal County District Attorney’s Office Officer—a factor that is often overlooked but deserves acknowledgment.


The Background

My father, is a veteran with significant health challenges, including cognitive disabilities, renal failure requiring thrice-weekly dialysis, and a catastrophic status due to his medical condition. Despite these overwhelming circumstances, he was charged with a serious offense following a medically induced domestic incident on January 18, 2022. As his son, caregiver, and power of attorney, I knew that my father’s condition made the standard legal processes inadequate for his situation.

The case was complex, filled with nuances and mitigating circumstances that were not immediately apparent to those unfamiliar with his condition. These included the impact of prescribed medications on his cognitive abilities and the lack of understanding surrounding his mental competency at the time of the incident


Reaching Out: A Letter That Made a Difference

Recognizing that the public defender’s office, burdened with heavy caseloads and limited resources, might not have the capacity to fully communicate these nuances, I decided to take action. On August 22, 2022, I drafted a deviation letter addressed to Ian M. Daranyi, the Pinal County District Attorney. This letter wasn’t just a formal request; it was a deeply personal appeal, grounded in the reality of my father’s condition and the facts of the case.

In the letter, I outlined:


My Father’s Medical Condition: I detailed my father’s cognitive disability, the side effects of his medication, and his catastrophic status as a veteran, all of which severely impacted his ability to participate in the legal process.


Stalled Plea Negotiations: I noted the lack of communication from the Deputy County Attorney since August 4, 2022, and proposed terms for a plea agreement that would accommodate my father’s condition, including a misdemeanor charge and no supervised release due to his inability to ambulate.


A Request for Compassion: I respectfully requested that the State deviate from its usual plea policy and consider the unique circumstances of my father’s case. I emphasized the urgency of a response and made it clear that if no agreement was reached within three days, I would need to escalate the matter to the court.


A Reasonable and Compassionate Response

To my relief and gratitude, the Pinal County District Attorney’s Office responded with a level of compassion and reasonableness that is not often discussed but is crucial in the pursuit of justice. The prosecutors recognized the undisputed facts of the case and the mitigating circumstances that I had communicated. They took into account the significant health issues and the nuances that made the standard legal procedures inappropriate for my father’s situation.


In what I believe to be an admirable display of fairness and humanity, the District Attorney’s office agreed to dismiss the charges against my father. This decision was not only a relief for our family but also a testament to the importance of communication and advocacy in the legal process.


Acknowledging the Prosecutor’s Role

It is important to acknowledge and applaud the role of the Pinal County District Attorney’s Office in this outcome. While it is easy to focus on the adversarial nature of the criminal justice system, this case serves as a reminder that prosecutors, too, have the capacity for empathy and fairness. By appealing to their sense of reasonableness and presenting the facts clearly and respectfully, we were able to reach a just resolution.


A Message of Hope

For anyone facing similar challenges, I hope our story offers a beacon of hope. The criminal justice system can be intimidating, but with persistence, careful communication, and a strategic approach, it is possible to achieve a fair outcome. This experience has taught me that while the system has its flaws, there are individuals within it who are willing to listen and act with compassion when the circumstances demand it.


As I reflect on this journey, I am deeply grateful for the outcome and for the opportunity to advocate for my father. This case has shown me the power of advocacy and the importance of appealing to the humanity in others, even within the legal system.
